Terms of Service

Welcome to Bunny Trails!
These Terms of Service ("Terms") govern your access to and use of Bunny Trails Cloud, a subscription-based rabbitry management application operated by Bunny Trails Software ("Bunny Trails," "we," "us," or "our").
By creating an account, subscribing to our service, or using Bunny Trails Cloud, you agree to these Terms and our Privacy Policy.
Please read them carefully.
1. About Bunny Trails Cloud
Bunny Trails Cloud is an online application designed to help rabbit breeders and enthusiasts manage their rabbitries.
Features may include rabbit records, pedigrees, breeding information, show records, contacts, transactions, photographs, reports, and other rabbitry management tools.
Bunny Trails Cloud is provided as a subscription service. Your subscription grants you access to the application but does not transfer ownership of the software.
We may add, modify, improve, or discontinue features as the application evolves.
2. Account Registration and Eligibility
You must provide accurate information when creating an account and keep your account information reasonably up to date.
The person responsible for purchasing and managing a subscription must be at least 18 years old.
Family subscriptions may include invited users between the ages of 13 and 17 with permission from a parent or legal guardian.
Bunny Trails Cloud is not intended for children under 13.
Each user is responsible for maintaining the confidentiality of their login credentials.
You agree to notify us promptly if you believe your account has been accessed without authorization.
Bunny Trails Software reserves the right to decline new registrations or refuse future service based on prior payment disputes, chargebacks, violations of our Terms of Service, or other legitimate business reasons, subject to applicable law.
3. Subscription Plans
Bunny Trails Cloud offers subscription plans that may include Single User and Family options.
Subscriptions may be billed monthly or annually, depending on the plan selected.
The features, pricing, and billing frequency applicable to your subscription will be displayed before you complete your purchase.
Automatic Renewal
Unless canceled, subscriptions automatically renew at the end of each billing period.
By subscribing, you authorize recurring charges according to your selected plan and billing frequency until you cancel.
Applicable taxes may be added to subscription charges.
Free Trials
We may offer free trials to eligible customers.
The length and terms of a trial will be disclosed during registration.
Unless otherwise stated, a trial that requires payment authorization will convert to a paid subscription when the trial ends unless canceled beforehand.
We will provide any trial reminders required by applicable law.
Price Changes
We may change subscription prices.
When a price change affects your existing subscription, we will provide advance notice and obtain consent or offer cancellation and refund rights where required by law.
4. Cancellation and Refunds
You may cancel your subscription at any time through the subscription management features available in your account.
Cancellation prevents future subscription renewals.
After cancellation, you will retain access to Bunny Trails Cloud through the end of your current paid billing period.
Subscription payments are generally nonrefundable, except as required by applicable law.
We understand that unexpected circumstances may arise. Refund requests may be submitted to bunny.trails@icloud.com and will be considered individually.
Nothing in these Terms limits any refund or cancellation rights provided by applicable law.
5. Account Expiration and Data Retention
When your subscription expires, access to Bunny Trails Cloud will be restricted.
Your account data will be retained for 30 days following the end of your subscription to allow you to reactivate your account.
If you reactivate within this period, your existing data will ordinarily be available again.
After the 30-day retention period, your rabbitry records, pedigrees, photographs, and other customer-created account data will be scheduled for permanent deletion.
Once deleted, this information cannot be recovered through normal account restoration.
Certain information, including billing records, transaction history, and information required for legal, tax, security, or regulatory purposes, may be retained longer.
Residual copies may remain in system backups until those backups expire according to our backup retention procedures.
We encourage customers to export important records before their subscription ends.
6. Family Subscriptions
Family subscriptions allow multiple users to access Bunny Trails Cloud under one subscription account.
The primary account holder is responsible for subscription payments and management.
Only the primary account holder may manage billing, invite additional users, or remove users from the Family subscription.
Shared Account Data
All rabbitry records and related information entered under a Family subscription belong to the subscription account as a whole.
All authorized users of the Family subscription may access, create, edit, delete, and manage records within that account.
Bunny Trails Cloud does not currently provide private rabbitry records or separate data ownership for individual family members.
The primary account holder is responsible for determining who should have access to the account.
Removing Family Members
The primary account holder may remove invited users from the Family subscription.
Removing a user revokes that person's access to the subscription account but does not automatically delete the rabbitry data they created or managed.
That information remains part of the Family subscription account and may be managed, modified, reassigned, exported, or deleted by remaining authorized users.
Users should understand that information entered into a Family subscription may remain accessible to other account members after their access ends.
Bunny Trails Software is not responsible for disagreements between family members concerning the management or ownership of records entered into a shared account.
7. Customer Data and Ownership
You retain ownership of the rabbitry information, photographs, documents, and other content you provide to Bunny Trails Cloud, subject to any rights held by other individuals or organizations.
For Family subscriptions, the account's authorized users collectively manage the data as described above.
By using Bunny Trails Cloud, you grant Bunny Trails Software a limited, nonexclusive license to store, process, reproduce, back up, display, and otherwise use your content as reasonably necessary to operate, maintain, secure, and provide the service.
We do not claim ownership of your rabbitry records.
We do not sell your rabbitry records or photographs to advertisers.
You are responsible for ensuring that you have the right to upload, store, and share the information you provide.
8. Data Imports and Exports
Bunny Trails Cloud may provide tools for importing and exporting rabbitry information.
Customers migrating from Bunny Trails Classic may request assistance importing their existing data.
You are responsible for providing a valid data file and confirming that you have the necessary rights to its contents.
Although we make reasonable efforts to import information accurately, differences between software versions, incomplete records, damaged files, and other factors may affect the results.
You are responsible for reviewing imported information for accuracy.
We recommend retaining an independent copy of your original data.
Exported files are your responsibility once downloaded.
9. Acceptable Use
You agree not to:
- Use Bunny Trails Cloud for unlawful purposes.
- Attempt to access another subscription account without authorization.
- Interfere with the security or operation of the service.
- Upload malicious software or harmful content.
- Attempt to reverse engineer, copy, or redistribute the application except where permitted by law.
- Use automated methods that unreasonably interfere with the service.
- Upload content that violates another person's intellectual property or privacy rights.
We may suspend or restrict access when reasonably necessary to protect the service, other customers, or comply with legal obligations.
10. Service Availability and Data Security
We work to provide a reliable and secure service.
However, no internet-based application can guarantee uninterrupted availability or complete protection against every technical failure or security incident.
Bunny Trails Cloud may occasionally be unavailable due to maintenance, updates, hosting issues, network interruptions, or circumstances beyond our reasonable control.
We use reasonable measures designed to protect customer information and maintain service reliability.
We recommend periodically exporting important rabbitry records and maintaining independent copies of information that would be difficult to recreate.
11. Software Ownership
Bunny Trails Software retains all rights, title, and interest in Bunny Trails Cloud, including its software, source code, design, branding, documentation, and other intellectual property.
Your subscription provides a limited, nonexclusive, nontransferable right to use the application according to these Terms.
You may not reproduce, resell, distribute, or commercially exploit the application itself without our written permission.
This restriction does not prevent you from exporting or using your own rabbitry data.
12. Accuracy of Information
Bunny Trails Cloud provides tools for recording and organizing rabbitry information.
We do not independently verify customer-entered information, including pedigrees, registrations, breeding histories, health information, show results, or ownership records.
You are responsible for the accuracy of information you enter or import.
Bunny Trails Cloud does not provide veterinary, medical, legal, or professional breeding advice.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Bunny Trails Software will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
This includes, where legally permitted, losses involving business interruption, lost profits, or lost data.
To the fullest extent permitted by law, our total liability for claims arising from the service will not exceed the amount you paid Bunny Trails Software during the 12 months preceding the event giving rise to the claim.
These limitations do not apply where prohibited by law or to liabilities that cannot legally be limited.
14. Suspension and Termination
We may suspend or terminate access if you materially violate these Terms, misuse the service, or create a significant security risk.
Where reasonably practical, we will provide notice and an opportunity to resolve the issue.
We may also discontinue the service or terminate subscriptions for legitimate business reasons, subject to applicable notice and refund obligations.
Data retention following termination will depend on the circumstances and applicable legal requirements.
15. Changes to These Terms
We may update these Terms as our services, business practices, or legal obligations change.
When changes are material, we will provide appropriate notice before they take effect.
If a change requires your affirmative consent under applicable law, we will obtain that consent before applying the change.
The current version of these Terms will remain available through Bunny Trails Cloud.
16. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles, except where applicable law provides otherwise.
Nothing in these Terms limits mandatory consumer protections available under applicable law.
